The Trial Begins
Discover what happens inside a courtroom.
When a serious legal dispute cannot be resolved privately, it usually ends up in a court. A civil case typically involves a plaintiff who brings a lawsuit against a defendant. In a criminal case, however, a prosecutor represents the government against the accused person.
Both sides will usually hire a professional lawyer to argue their case. They present their arguments before a judge, who oversees the trial and ensures all rules of law are followed strictly. Sometimes, a group of ordinary citizens called a jury sits in the courtroom to listen to the trial and decide the final outcome.
During the trial, each legal team presents facts and physical evidence. They will also call a witness to the stand to testify under oath. If a person is legally required to testify, they will receive an official document called a subpoena in the mail.
Emotions can run high! A lawyer might suddenly stand and shout "Objection!" if they believe a question asked by the opposing side is unfair or breaks a rule. After all arguments are made, the jury or judge will deliberate and deliver a verdict of guilty or not guilty. If found guilty in a criminal trial, the judge will then determine the appropriate sentence.
